**HOTEL MEAD GYM & POOL MEMBERSHIP

WAIVER AND RELEASE OF LIABILITY**

This Waiver and Release of Liability Agreement (“Agreement”) is entered into by {name}, Date of Birth {dob}, residing at {address}, phone number {phone} (“Member”), in favor of Hotel Mead Resort & Convention Center (“Hotel Mead”).

1. ASSUMPTION OF RISK

I, {name}, understand and acknowledge that participation in gym, fitness, wellness, and swimming pool activities involves inherent risks, including but not limited to slips, falls, drowning, overexertion, equipment failure, heart attack, paralysis, serious injury, or death.

I voluntarily choose to participate in these activities with full knowledge of these risks and freely assume all risks, whether known or unknown, foreseeable or unforeseeable.

2. NO LIFEGUARD ON DUTY

I acknowledge and understand that THERE IS NO LIFEGUARD ON DUTY at the Hotel Mead swimming pool at any time.

I agree that:

• I am responsible for my own safety and the safety of any guests or minors accompanying me.

• I will not swim or use the pool if I am unable to do so safely.

• Children must be supervised at all times.

3. RELEASE OF LIABILITY (INCLUDING INJURY OR DEATH)

In consideration of being permitted to use the gym, pool, and related facilities, I hereby release, waive, discharge, and hold harmless Hotel Mead, its owners, officers, employees, agents, affiliates, and representatives from ANY AND ALL LIABILITY, claims, demands, actions, or causes of action arising out of or related to:

• Personal injury

• Illness

• Property damage

• Permanent disability

• Death

This release applies whether caused by negligence or otherwise, to the fullest extent permitted by law.

4. MEDICAL ACKNOWLEDGMENT

I represent that:

• I am physically and mentally capable of participating in gym and pool activities.

• I have no medical condition that would make participation unsafe, or I have consulted a physician.

• Hotel Mead has no responsibility to provide medical care.

In the event of an emergency, I authorize Hotel Mead to seek medical assistance on my behalf, understanding that I am solely responsible for all medical costs incurred.

5. PROPERTY & PERSONAL BELONGINGS

I understand that Hotel Mead is not responsible for lost, stolen, or damaged personal property, including but not limited to clothing, jewelry, phones, wallets, or fitness equipment.

6. RULES & CONDUCT

I agree to:

• Follow all posted gym and pool rules.

• Use equipment properly and as intended.

• Refrain from reckless, unsafe, or disruptive behavior.

• Exit the facility immediately if directed by Hotel Mead staff.

Failure to comply may result in suspension or termination of membership without refund.

7. MINORS (IF APPLICABLE)

If the participant is under 18 years of age, the undersigned parent or legal guardian agrees to all terms of this Agreement on behalf of the minor and assumes full responsibility and liability for the minor’s participation.

8. INDEMNIFICATION

I agree to indemnify and hold harmless Hotel Mead from any claims, damages, or legal fees arising from my actions or the actions of my guests while using the facilities.

9. SEVERABILITY

If any portion of this Agreement is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

10. ACKNOWLEDGMENT & SIGNATURE

I confirm that:

• I have read and fully understand this Agreement.

• I understand that I am giving up substantial legal rights.

• I am signing this Agreement voluntarily and without coercion.
